The Macomb County Circuit Court has two locations: The Circuit Court location is: 40 N. Main St., Mt. Clemens, MI 48043 All Judges are located on N. Main in downtown Mt. Clemens. Follow 'Directions to the Court Building' in the right bar for a map to our N. Main location. The Juvenile Division is: 380 N. Rose, Mt. Clemens, MI 48043* For a map to the Juvenile Division location follow the 'Juvenile Division' link in the left bar. *As of June 1, 2005, the juvenile referees, except for Referee John Kennedy, moved into the Circuit Court Building on N. Main in downtown Mt. Clemens. There is a parking structure next to the Court building. The public spaces are on the top two levels of the structure. The cost is $4, which must be paid through an automated kiosk on the C level before exiting. There is metered angle parking in front of the Court building for short visits. The City of Mount Clemens also maintains several metered parking lots a short walk away. SMART offers a free shuttle service to a parking lot on North River Road. The shuttle runs from 7:15 a.m. until 5:30 p.m. and transports passengers every 15 minutes. Contact SMART for more information at (586) 469 7433. The standard business hours of the Court are 8:30 a.m. to 5:00 p.m., Monday through Friday. In the following instances the business hours of Departments of the Court vary from standard business hours: The hours for holding court in the courtrooms are from 8:30 a.m. to Noon and 1:30 p.m. to 5:00 p.m., unless a judge directs that his or her hours of holding court are 8:00 a.m. to Noon and 1:30 p.m. to 4:30 p.m. or unless otherwise ordered by the trial judge or the Chief Judge in a particular case. Orders and judgments may be submitted to judges’ clerks for signing and entry only during the hours of 8:30 a.m. to Noon and 1:30 p.m. to 4:30 p.m. With the permission of the Chief Judge, specific offices of the Court may maintain public service hours of 8:00 a.m. to 5:00 p.m. Court Administration is available to serve the public from 8:00 a.m. until 5:00 Monday through Friday. Clerk's Office Hours: Court Section and Fileroom: Monday, Wednesday, and Friday - Open 8:00 a.m. to 4:15 p.m. (4:15 p.m. to 4:30 p.m. a DropBox with coversheets will be provided for court filings. All documents received in the DropBox during closed times will be Date Stamped the same day and Processed the next business day.) Tuesday and Thursday - Open 8:00 a.m. to 1:30 p.m. (1:30 p.m. to 4:30 p.m. a DropBox with coversheets will be provided for court filings, etc.) The Clerk's Office will be Closed to the Public from 1:30 p.m. to 4:30 p.m. Vital Records: Monday - 8:00 a.m. to 4:30 p.m. Tuesday - 8:00 a.m. to 1:30 p.m. Wednesday - 8:00 a.m. to 7:00 p.m. (late hours) Thursday - 8:00 a.m. to 1:30 p.m. Friday - 8:00 a.m. to 4:30 p.m. NOTE: If a holiday falls on a Monday, then the following Tuesday, the Clerk's Office will remain open and not close at 1:30 p.m. The Elections Office, Jury Room, and Register of Deeds will continue regular business hours of 8:00 a.m. to 4:30 p.m., Monday through Friday. The Macomb County Circuit Court Friend of the Court is directed by law to maintain non-standard business hours for the convenience of customers. Offices and Departments of the Court For information on the Offices and Departments of the Court, follow the link in the left-hand box to "Departments of the Court." The Macomb County Clerk is the Clerk for the Macomb County Circuit Court. The Court Section of the Clerk's Office maintains the Court files, indexes and other records of the Court and permits access to these records in accordance with the law. Computer terminals are available in the Court Section for the public to review Court records. Copies of documents may be obtained from the file room of the Clerk's Office. Lawsuits are initiated by filing the necessary documents with this department. All case related filings are done with the Clerk of the Court. The Court Section is located on the 1st floor of the Macomb County Court Building, 40 N. Main, Mount Clemens, MI 48043. Filing Fees Filing Fees in the Circuit Court are set by statute and Michigan court rules. This link takes you to a Web site listing Circuit Court Fees. This site is maintained by the State Court Administrative Office and is periodically updated. The fee for filing a motion is set by MCL 600.2529(1)(e). Motions are further governed by Michigan court rule 2.119(G). The wavier or suspension of filing fees is governed by MCR 2.002. A case type code must be assigned to each case filed in the Circuit Court according to the principal subject matter of the action. Cases may brought to the attention of judges on miscellaneous motions under Michigan Court Rule 2.119. The motion day in the Macomb Circuit Court is Monday. In the event a Monday is a court holiday, motions will be held the next day, Tuesday. Motions are scheduled in the morning, except that the Family Division directs domestic relations motions in which the parties are representing themselves (called 'pro per') are scheduled on Monday afternoons at 1:30 p.m. and are heard by Friend of the Court Referees. Pursuant to statute, the Circuit Court annually creates an alphabetical list of the bail bond agencies authorized to post bonds in the County of Macomb. Bail bond companies wishing to be added to the Macomb County approved list of bail bond agencies must fill out the required application form. Companies may no longer submit information on letterhead. When submitting your application form, please include the following: 1) application; 2) current proof of licensure by the Michigan Insurance Commissioner for each agent; 3) copy of qualifying power of attorney from the insurance company representing each agent; and 4) a print-out from the State of Michigan's DLEG insurance agent search site for each agent. The Chief Judge of the Macomb County Circuit Court has appointed the following persons as independent contractor court officers to seize property or conduct evictions, pursuant to MCR 3.106. Under MCR 3.106(B)(1), the Macomb County Circuit Court provides that property shall be seized and evictions conducted only by: (a) court officers and bailiffs serving this Court; (b) Sheriffs and Deputy Sheriffs; (c) officers of the Department of State Police in an action in which the State is a party; and (d) police officers of an incorporated city or village in an action in which the city or village is a party.
