Plaintiff / Defendant Examples

Who is the plaintiff?

A party who sues another party is called the plaintiff.

Who is the plaintiff?

The party being sued is called the defendant.

Can there be more than one plaintiff or defendant?

There can be more than one plaintiff or defendant in the same action. An example would be when a husband and wife sue another husband and wife.

Who can file and appear in court? (See table below)

Plaintiff is: Who may file and appear in court:
Individual Any adult may file and appear on his/her own behalf
Partnership Any partner or full-time salaried employee with knowledge of the claim.
Proprietorship The proprietor or any full-time salaried employee with knowledge of the claim.
Corporation Any full-time salaried employee with knowledge of the claim.
